OTUZCO COMMENTS FOR NOT HAPPY WITH THE REGULATION UNDER THE INABILITY

FORUM WHAT THE PANEL
WE LEAVE COMMENTS ON THE REGULATION OF THE LAW 28529
LAW GUIDE TOURISM

accept the invitation with pleasure electronically by Edith Muñoz (past president of AGOTUR LIB) Panel Forum "Tourism Guide Law and Regulations." High attendance indicates the importance of the topic. Attendees included professionals in Tourism (Guides and Graduates), students and graduates of the technical race Official Guide "practical guides, travel agents and tourism, and owners of tourist services. Panelists at the table of representatives of tourism associations, GERCETUR and two archaeological projects (Huaca de la Luna and El Brujo).

Undoubtedly the Regulation of Law 28329, Law on Tourism Guide, is one of the documents that were expected since 2005 by industry players.

To all the attendees were many doubts about the "interpretation" of the regulation in question. But I think the Panel was not interpreting them as there is no chapter or article and clause ambiguous. This regulation was fought by the National Federation of Tourist Guides Peru (FENAGUITURP), and participated in the drafting of national tourism associations and entrepreneurs. Then from its official birth (published in the Official Journal "El Peruano") played the game were already given and there was more to put into practice from the day following its publication. And I think this Panel Forum, was to explain and publicize the actors in the sector, the content of this legal document. Very much regret that the event has become a gathering of "tolerances", "concessions" and even trying to change the contents of Regulation of Law 28529 for the attendees to take the regulation as a threat to their business interests.

Here are some comments with reference to the specific requirements of those who still refuse to accept reality.

DOMAIN REQUIREMENT OF FOREIGN LANGUAGE

Actually this country going from bad to worse, or perhaps every day we take more notice of what is the inefficient public education system. I say this because this country's major problems lie in its two pillars: education and health. In one of the requirements for registration of this Official Tourist Guides to present a certificate from an institute to dominate the foreign language or affidavit. Although the standard is given and must be complied with, I wonder Is that the Peruvian government will continue to spend our money to put in compulsory education sylabus Language English / French in high school and in this specific case in the race GOTUR ? What good is education impose foreign language in public classrooms if we are asked after the certification of an institute specializing in foreign languages? The answer is obvious, then the MINCETUR with the Ministry of Education should reach an agreement and the state to stop wasting time and money in the hours devoted to teaching a course in practice have no validity whatsoever.

CASTILIAN LANGUAGE AND OUR SOVEREIGNTY (IDENTITY)
On the other hand, some panelists complained that there are no professional guides who are fluent in English and another foreign language. If we focus on our reality Who dominated the Castilian language (known as English) in this país?
And if by "x" reasons one decides Guide to English speakers, why have to be imposed to speak another language? And if tragedies occur naturally (as in the case of Cusco at present) or without going too far, after prolonged and unexpected rains in Trujillo and Chan Chan was forced to close its doors to visitors. If only Peruvian to Lead, How does the foreign language will help me? Are you not that the rules of neo-colonialism? And without going too far before the financial crisis, exports fell significantly, and asparagus are aware of the dangers of monoculture meet the demanding market, knowing the biodiversity of our flora and
fauna ...

One of the panelists talked about what would happen if tomorrow cruisers arrived with 500 German and there are no guidelines in German? Utopian view of this probability, I think it is irresponsible to promote a tourism product when human resources are unable to supply the load in this case with regard to language. And if the worst these 500 Germans decide to disembark at the port of Salaverry, they would have to adapt to reality: first, agreeing to be guided in English (for many Germans their second language), or second, to be guided by a tour guide and translator (if there is not enough translators). Germany is also known as Das Land der Dichter und Denker (The Land of the poets and thinkers).

Hence, once again, beware of excessive promotion of tourist destinations when they are not prepared or are simply not ready in all its components. In France, Chapter I: The sovereign announced in its second article: The language of the French Republic is French ( http://www.assemblee-nationale.fr/connaissance/constitution_1209.pdf ). As
aims to create a national identity when the language of the Constitution deals with Article 48 (case of Peru) and now it is another foreign language before mastering the

our ... Without deviating from the concern of the panelists, I reply that if there are guides who can communicate in English and other languages. But, seeing that in the stately and noble city of Trujillo, some travel agencies employ any child of the neighbor or friend to "speak" a foreign language, and thus usurp the functions of a professional in tourism, they had to migrate to other economic activities and even work on cruises and other countries. This created a huge labor gap, where a number of tourism professionals spent the ranks of the unemployed. That's the reality. And the problem is that those employers have saved mercantilist that the dignity of hiring a professional in the field other professionals have turned to other subjects and so pay them what they want. Causing a labor problem with dire consequences for national identity.

DISORDER How many times have I listened to professionals from other careers to be unemployed began to usurp the functions of Guides, as they have always considered this sacred profession as a kind of fun, to be paid "just talk of the Incas. " Then maybe Is not that the reason that dozens of colleagues Guides, to see this reality had to migrate from their workplace? And what about the Peruvian Creole, those individuals (where few have trodden a month the classrooms of a college or university in the race cars), have mutated haulers to "tour guiding" and now "practical guides. . Of course, seeing as the authorities have allowed both chaos, these individuals believe they have every right to impose and even bragging rights! Who has created this mess? Is the limit! FOREIGN

"guiding" - REGULAR STUDIES
Some foreign friends who live in Trujillo for some time, are concerned also by the regulation, as seen in an obstacle to continue their economic activities. I know many friends in Cusco, of French origin for example, had to study for 03 years in the profession Cusco Tourist Guide. Why have invested in this? Because they live off tourism and adapted to the system.
Why could not do the same in Trujillo? It is an investment of time and money. I would recommend to do so. Peru is perhaps one of the few countries where the Peruvians themselves take us "cholitos." Let me understand, if I went to France to live and watch (although difficult) there are no guidelines in English, I'm going to try to impose and say that the rules of the French guide is wrong and let me guide in English ... In no way would these "tolerances" or "concessions." Because it would first have to have a work visa (if not a resident) would then have to validate my studies and then practice my profession. Otherwise would be deported to Peru for not following the French laws. You just can not not "tolerate" or grant. The regulation in question is very clear and in contrast to all think, provides the professional foreign tourists (so that tourism has continued studies in another country) and thus validate his studies to practice the profession of Tourist Guide. Friends from other countries who took to Peru as his second home, please, more facilities can not have and what remains now is just regularize their employment status.
The language does not make professional quality, the "domain" of a foreign language is a tool for the professional job expansion in tourism longs; language that can be followed by economic or cultural affinity. But it should not be imposed, since it is prevalent in a professional knowledge of the race in a row and not the languages \u200b\u200bin which they communicate.
is said that at Huaca de La Luna, according to registration numbers of visitors, origin of visitors is Germany and that Trujillo has no Professional Guides in German. Totally true, but is that all Germans speak only German? No sir, more than 60% of Germans speak English as a second language and speak it perfectly. I am quite sure that those visitors of German origin was visited using the services of travel agents who offer tours Trujillanos to S/.25.00 including transport and "Guide." And we know well these realities of tourist visits are half English and half in English. And those Germans signed up for the visit in English. Except perhaps a small percentage that are "guided" by Germans living in Trujillo. UNESCO announces
Languages \u200b\u200band multilingualism "Linguistic diversity is an essential element of cultural diversity. As multilingualism, has a stake in sustainable development and strengthening dialogue, social cohesion and peace. "Taking into account the linguistic and biological diversity in the world and the risk that these disappear UNESCO has published an atlas http://www.unesco.org/culture/ich/index.php?pg=00206

OTHER PROFESSIONALS WHO WANT TO BE PRACTICAL GUIDE
Law 28529 was published in 2005 and spent 05 years for to be regulated, time enough for the Practical Guide to regularize their status and join the professional family of Tourist Guides. But they have not done though and they live on the Guiding himself admitted, and aim to continue. So it's no surprise this content. Some think that paying your entry fee - which is a separate topic as the administrator of the resorts can give free entry - could continue to "guide." It is not well estimated, because now that they usurp the professional role of an Official Guide will be against the law and as such will be punished. Every Peruvian has the right to communicate to your family and friends past and present of its natural and cultural environment but if this is done under commercial then the song is another ... The issue of payment of entry is another scheme (for the guides practical) and a condition of the administration of the Centers of interest (for the money by raising entry fee goes to pay staff), as once again is focusing on only the archaeological and monumental commercial value (if it is commercial) but what would happen if we see a pseudo guide usurping the functions in a visit to the wholesale market / Hermelinda? Here's a critique for the Official Guides which is focusing only to protect their next business environments. Colleagues need to go beyond our horizons. Peru has a variety of tourism which unfortunately for recovery mercantilist, the other being lost.
Finally, Law 28529 states and is very clear who can exercise the practice of guiding.
WARRANT THE REGULATION OF GOOD PRACTICES AND gentlemen
operators and travel agents, there is no reason for alarm. The Rules of the Law on Tourism Guide, ensures best practices in tourism. Ensures that its consumer market with a good partner, since the regulation is also demanding and the card is renewable every three years. Will order and ensure the professionalism of the Tourism Guide. I am sure that this step will ensure the quality of tourism services offered and generate an order in the sector. It is normal that those who were accustomed to the informality are the regulation in question as an obstacle, it requires a sustainable change, something that those individuals have no concept of what it means.

GERCETUR We are confident that the LL, has all the positive encouragement to regularize the Registry of Tourist Guides and thereby continue on the path of responsible tourism that we all want to follow.
From this rostrum a cordial greeting to the collective and individual who made the Regulation of Law 28529, Law on Tourism Guide. Sincerely
: Víctor Corcuera Cueva
